1. KwikLink agrees that all information, records, files, input materials, and other data received through the Backup Pro service are the exclusive property of the Customer and that all such records shall be furnished to the Customer (at Customer’s own expense) at Customer’s Request.

2. KwikLink Internet Services will provide Customer with initial support regarding the installation of communication lines and shall advise Customer as to any additional equipment required. The cost of all such additional equipment and services requested by the Customer shall be paid by the Customer in accordance with such terms and conditions as agreed to by the parties.

3. If the Customer wishes destruction of data at the KwikLink Data Centre, the Customer shall provide to KwikLink written authorization signed by an authorized signing officer of the Customer whose data is being deleted.

4. Termination – All KwikLink Backup Pro accounts will renew automatically on the anniversary date of the service agreement unless a cancellation is requested by the customer. In the event of a cancellation, KwikLink may immediately dispose of all Customer data that is stored within the KwikLink Data Centre related to the KwikLink Backup Pro service.

5. Limitation of Liability – In addition to the limits on liability included elsewhere in this Agreement, under no circumstances shall KwikLink Internet Services and its Licensors be liable to Customer or any other party or entity for loss of goodwill or business profits, work stoppage, data loss, computer failure, or malfunction, special, incidental, consequential, or indirect damages, any and all other commercial damages, or exemplary or punitive damages. The services are provided “as is” without warranty or condition of any kind, whether express or implied, including all implied warranties and conditions of merchantability and fitness for a particular purpose and non-infringement.
